Interpretation: In these conditions the expression “the Carrier” means Blue Reef Fishing Charters, its servants, owners, contractors, agents, employees and any person or corporation with whom Blue Reef Fishing Charters may have arranged to conduct the cruise. The expression “the Charter/passenger” shall mean the Charter/passenger and guests who are carried on the cruise. The expression the organiser, payee, payer and organisation means the initial contact or person responsible for the organisation and booking of the cruise.
Compliance with directions: The Charter/passenger shall comply with any orders and instructions issued by Carrier pursuant to these terms and conditions and with any terms of any notice exhibited on the ship and with the instructions of the Carrier and shall be responsible for any damage or loss occasioned by its failure to do so.
Passengers own risk: The Charter/passengers boarding and disembarking the ship do so at their own risk. The Carrier takes no responsibility for damage, injury, death or loss of any nature whilst the Charter/passengers are boarding and disembarking the ship. The Charter/passengers on the ship, their luggage, goods and personal items are carried entirely at their own risk. The Carrier accepts no responsibility for damage including death, injury, delay or loss of any nature arising out of incidental to the Cruise or any service ancillary to it (including transport of any passenger, luggage, goods and effects to and from any wharf or jetty and including any substituted method of carriage as otherwise provided in these terms), and the Charter/passengers for themselves and their legal personal representatives renounce all claims against the Carrier in respect thereof whether same may be due or alleged to be due to negligence or misconduct on the part of the Carrier or not.
Vessel Signage: Charter/Passengers boarding and onboard the vessel do so under their own risk and by the terms and conditions as stated in the terms and conditions signage on the vessel. Charter/Passengers will abide by all signage aboard the vessel at all times. Charter/Passengers that breach signage rules onboard the vessel may be ejected from the Cruise at the discretion of the vessel muster. No refund given.
Fish and Fishing Equipment Injuries: The Carrier will take no responsibility or liability for Charter/Passengers whom are injured from fishing activities, fish caught, fish related injuries, fishing equipment, hooks, line, sinkers or the failure of fishing equipment whilst onboard the vessel. Charter/Passengers holding fishing equipment do so at their own risk and all fishing equipment on the vessel at any stage throughout the duration of the Cruise is subject to these terms and conditions.
Substitute Ship: The Carrier reserves the right with / without reasonable notice to substitute any ship before the commencement of the cruise, to alter or omit an advertised stopping place and to commence the cruise before or after the commencement time advertised or announced for its departure. All these terms and conditions shall extend to carriage by any substitute ship.
Cancellation: The Carrier reserves the right at any time to cancel the cruise or vary the cruise for any reason and shall not under any circumstances be under any liability to the Charter/passenger and/or booking agencies for failure to undertake the cruise at the scheduled time or at all. Unruly, drunken, illegal or dangerous behaviour may, at the sole discretion of the vessel master, business owner or designated person ashore, result in the immediate ejection of any and all passengers at the nearest permissible wharf area with no refund. No illegal or prohibited items are to be carried onboard the ship by the Charter/passengers and failure to comply will result in immediate cancellation of charter with no refund.
Liquor Restrictions: The Carrier is not permitted to sell onboard the vessel any liquor and the Charter/passenger acknowledges that the Carrier is not permitted to sell liquor on the vessel. Charter/passengers must accompany any consumption of alcohol with food. A limitation of 6 standard drinks per person is to be consumed throughout the duration of a cruise.
BYO Catering: The Charter/passenger agrees to be responsible for providing all necessary catering items including; crockery, cutlery, napkins, serviettes, linen etc. No food or beverages are to be served or provided by the Carrier as per insurance liability coverage.
Damage or Loss of Carriers Equipment: The Charter/passenger are responsible for replacement cost of lost, damaged and misused fishing equipment, vessel fittings and damages to Carrier property whilst on cruise where the nature of lost, damaged or misused equipment is the Charter/passenger fault. On the spot payments via credit card will be charged for replacement cost at current full retail pricing. Booking name is responsible for payments of recovery costs and this will be added to total cruise pricing. Deliberate acts of vandalism or damage will result in water police response and criminal prosecution charges will be pursued.
Substitute Carrier: The Carrier may arrange for another carrier to undertake the cruise covered by these terms and conditions as a result of which the same terms and conditions apply.
Sea Sickness: The Carrier accepts no responsibility for sea sickness, motion sickness or any medical issues due to weather, wind, ship motion and sea conditions which may effect medical conditions. The Charter/passenger will be responsible for supplying their own sea sick medication and the Carrier will not provide any sea sick medication. Any Charter/passenger that becomes affected by motion sickness will not be permitted to transfer to an alternative ship and the cruise will conclude at the scheduled stoppage time. Where other Charter/passengers cruise time and money is at stake, Charter/passenger will not be returned to the wharf early due to motion sickness unless the vessel master believes a medical emergency exist. No refunds or compensation for lost cruse time will be accepted by the Carrier and the Carrier accept no liabilities for lost time.
Cancellation Fees: The following cancellation fees will be payable in the event of cancellation of the cruise for any reason other than the default of the Carrier. (20 days or more prior, full refund of all monies paid) – (15-20 days prior, $400.00 deposit or booking deposit will be lost. Where as deposit payments are not paid by carrier, payer, oganiser or organisation, a $400 booking fee will be charged). (Within 14 days prior– full payment of charter 100%. Ticket purchases and vouchers included and carriers, payees that have not prepaid deposits or final balances will be charged). These fees may be varied at the discretion of the Carrier. Where deposit payments are made, charters/cruises cancelled within 14 days will be charged the remaining minimum charter hire cost of $1500.00 less deposit payments or total amount quoted by cruise where deposit payments are not made. Ticket purchases and vouchers are 100% non-refundable.
Ticket Sales: Ticket purchases for individuals or smaller groups have a 12 month expiry time from the date of purchase. Where tickets are not redeemed prior to expiry date, tickets there after will be deemed as not used and no refund given. Minimum numbers of 8 seats or more must be booked for the Carrier to conduct a cruise for individual ticket purchases and individual passengers cruises. If minimum seat are not booked, the Carrier will contact the Charter/passenger and advise them of the cancellation. Alternative dates will be advised to the Charter/passenger for a reschedule date. Payment of a ticket by the Charter/passenger and or the recipient/s of a ticket indicates acceptance of these term and condition. Ticket expiry dates may be extended at the discretion of the Carrier due to COVID Trading restrictions or unforeseen circumstances. Ticket purchases are 100% non refundable.
Confirmation of Numbers: The Charter/passenger shall provide to the Carrier at least 3 days prior to the commencement of the cruise, details of the number of passengers participating in the cruise, however should the Charter/passenger have cause to increase the numbers within this period, the Carrier will make every reasonable effort to accommodate the change. Additional cost will apply to final head count for additional passengers as per website list pricing.
Deposit – At the sole discretion of the Carrier, a deposit may be required as deposit against any potential damage. The deposit does not imply a maximum liability whatsoever nor change any of the requirements for the Charter/passenger to indemnify the Carrier as shown in the terms and conditions above.
Accounts: Payment must be made in full at the boarding point prior to the cruise departing. All prices that are quoted include 10 % GST. Please note that we accept credit cards for easy payment. To meet excessive commission fees, we require an additional 1.5% charge to process all credit card transactions.
Statutory Rights: Nothing in these terms and conditions shall be read or applied so as to purport to exclude, restrict or modify or have the effect of excluding, restricting or modifying the application in relation to the supply of goods and services or any of the provisions of Part V of the Trade Practices Act 1974 (as amended) or any relevant State or Territory statute which by law cannot be excluded, restricted or modified provided that to the extent that any such statute permits the Carrier to limit its liabilities to compensate or indemnify any person for such breach of a condition or warranty thereby implied, then the respective liabilities of the Carrier for any such breach shall be limited in the case of goods to the replacement of the goods or supply of equivalent goods and in the case of service to the resupply of those services.
Applicable Law: The conditions shall be governed by and construed in accordance with the laws of New South Wales and any proceedings against the Carrier shall be brought in that State.
Acceptance of Terms and Conditions: All Charter/passengers onboard participating in the cruise under the booking name or as a guest under a booking name indicates acceptance of these terms and conditions. Any Charter/Passenger onboard, boarding or disembarking indicates acceptance of these terms and conditions. Each Charter/Passenger holds their own responsibility to read the terms and conditions and each vessel displays correct signage indication of the terms and conditions and daily vessel induction speech by vessel Master informs all Charter/Passengers of their responsibility to read terms and conditions.
